General. LendingTree, LLC is a Delaware limited liability company with its corporate headquarters located at 1415 Vantage Park Drive, Suite 700, Charlotte, North Carolina 28203. Any reference in this Licenses and Disclosures to “we” or “us” or similar words shall refer to LendingTree, LLC unless otherwise indicated, all such entities referred to as “LendingTree”. Any reference in Licenses and Disclosures to “you” or “your” means the person(s) using the LendingTree Websites (as defined in the Terms of Use Agreement), and/or the good, facilities or services of LendingTree offered through alternative methods. LendingTree is a marketing lead generator, required to be licensed as a Mortgage Broker or other state license designation. LendingTree DOES NOT take mortgage applications, originate, service, make loans or credit decisions in connection with loans, nor does LendingTree issue commitments or lock-in agreements. LendingTree’s services are only administrative. Any loan inquiry you submit is NOT an application for credit. Rather, it is an inquiry to be matched with Lenders to receive condition loan offers from Lenders. You may have to complete an application with a Lender before they will extend an unconditional offer. A Lender you select may require you to pay an application or other fee to cover the costs of an appraisal, credit report or other items. The Lender, not LendingTree, will determine the amount of any such fee and should provide information to you regarding the refundability of any such fee. LendingTree, LLC does not endorse or recommend the products of any particular Lender.

Except as otherwise provided for your state, LendingTree, LLC is not an agent of you or any Lender. You should rely on your own judgment in deciding which available loan product, terms and Lender that best suits your personal financial requirements. The Lender is solely responsible for its services to you, and you agree that LendingTree, LLC shall not be liable for any damages or costs of any type arising out of, or in any way connected with, your use of such services. You understand that Lenders may keep your loan request information and any other information provided by LendingTree, LLC or received by them in the processing of your loan request, whether or not you are qualified for a loan with them or if you make a loan with them. In addition, LendingTree, LLC may receive personally identifiable information regarding the disposition of your loan from the Lender in order to fulfill its regulatory requirements as well as for internal business purposes. You agree to notify any particular Lender directly if you no longer want to receive communications.

Fees. LendingTree does not charge you any fee for its services. LendingTree receives its compensation from the Lenders or Providers for the goods, facilities and services provided by LendingTree. LendingTree’s compensation varies by product and service. Marketing fees paid by the Lender or Provider may be included in your rate, points, or term. Although some state licensing laws treat fees paid in exchange for marketing lead generation services as mortgage broker fees or origination fees, this is not the case under federal law. See the Terms of Use Agreement for details.

Credit. Any loan request you submit is NOT an application for credit. Rather, it is a request to be matched with Lenders to receive conditional loan offers from Lenders. You may have to complete a full application with a Lender before they will extend an unconditional loan offer. A Lender you select may require you to pay an application or other fee to cover the costs of an appraisal, credit report as well as for other items. The Lender will determine the amount of any such fee(s) and should provide information to you regarding the refundability of any such fee(s).

Federal Disclosures. Any request will be forwarded to Lenders, Brokers, Dealers, or Partners (depending on product selected) and these Partners may make certain disclosures to you. These disclosures, which are required by the Truth in Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA), and certain other federal and state laws, include details of your cost of credit; good faith estimates of your settlement costs (GFE) on August 1, 2015 the GFE will be called the Integrated Loan Disclosure or Loan Estimate and will be delivered to you by the Lender you select to proceed with for your loan needs; HUD mandated booklets “Guide to Settlement Costs” and/or “When your Home is on the Line”; notices concerning the possibility that your mortgage loan servicing may be transferred; and your right to a copy of any appraisal, if any, performed on your home. The Equal Credit Opportunity Act (ECOA) prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to enter into a binding contract), because all or part of the applicant’s income derives from any public assistance program, or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act. The agency that administers compliance with this law varies by Lender depending on its lending authority, but may include the Federal Trade Commission, Equal Credit Opportunity, Consumer Response Center, Washington, DC 20580 or at 1-877-FTC-HELP (1-877-382-4357; TDD 1-866-653-4261; or at www.ftc.gov.

If your loan request is forwarded to a Lender that makes you an offer, you should receive from the Lender a good faith estimate (GFE) required under RESPA, on August 1, 2015, the GFE changed to be known as an integrated disclosure and referred to as an initial Loan Estimate and will have both the RESPA and TILA disclosures. The new disclosure statement required under the TILA/RESPA, is required to be delivered within three (3) business days from the date you submit an application to a Lender. If the Lender denies your request for credit and that action is based, in whole or in part, on any information contained in a consumer credit report, you have the right to obtain, within sixty (60) days, a free copy of your consumer credit report from the credit reporting agency that compiles and maintains files on consumers on a nationwide basis. You also have the right to dispute the accuracy or completeness of any information in a consumer credit report furnished by the consumer credit reporting agency by contacting that agency directly.

An applicant, if married, may apply for a separate account / credit.

LendingTree does not accept any fees from the consumer, including third party fees.

Consumer Protection Bond
A consumer protection bond is on file with the State of Maine. If you have a claim against our company which cannot be resolved through informal means, you may institute an action to recover your loss from that bond by filing a written complaint with the Director, Office of Consumer Credit Regulation, 35 State House Station, Augusta, Maine, 04333-0035.

Maryland

This Financing Agreement must include: (1) the term and principal amount of your loan; (2) an explanation of the type of mortgage loan being offered; (3) the interest rate that will apply to the loan and, if the rate is subject to final determination at a future date based on some objective standard, a specific statement of those facts; (4) the points, if any, to be paid by you or the seller, or both; and (5) the term during which the Financing Agreement remains in effect.

Massachusetts

Common Terms and Definitions

Equal Credit Opportunity Act (ECOA): A federal regulation which requires lenders to promote the availability of credit to all creditworthy applicants without regard to race, color, religion, national origin, sex, marital status, or age (provided the applicant has the capacity to contract); to whether all or part of the applicant’s income derives from a public assistance program; or to whether the applicant has in good faith exercised any right under the Consumer Credit Protection Act. The regulation prohibits creditor practices that discriminate on the basis of any of these factors.

Contract: A written binding document, describing terms of an agreement between two or more persons. (Keep all paperwork. Later, if there are any questions, you will have your agreement in writing.)

Annual Percentage Rate (APR): The cost of your credit as a yearly rate. APR is a combination of the interest rate plus the fees charged on your loan. APR is higher than the interest rate because it includes both fees and interest as finance charges. The calculation of APR is mandated pursuant to Federal Law (12 CFR Part 1026 – Truth in Lending Act (“TIL-APR”)). It is intended to provide a single value for a consumer to compare the cost of credit between one lender and another. Finance Charge: The dollar amount the credit will cost you. Finance charges include interest and may also include transaction fees and service fees.

Principal: The amount of money owed on a debt, on which interest is calculated.

Interest: The cost of borrowing money, generally a percentage of the amount owed.

Balance: The total amount of money owed to a lender.

Default: Failure to pay a debt as agreed to on a contract. When a loan is in default, the lender may demand full payment of the remaining debt.

Collateral: Security pledged by a borrower to protect the interests of the lender; in case of default, the lender may take ownership of the security, if any, pledged by the borrower.

Credit Bureau: A private company that keeps a record of your credit history for distribution upon request by authorized parties. When you apply for credit, a lender may request a credit report to review when considering your application.

Credit History: A record containing information about you, including your payment history on previous debts.

Credit Report: A report of the credit history and other information about you that is kept by credit bureaus, which may include: your name, address, social security number, payment history (good and bad), current and previous debts, employers, income, etc. Accurate information on a credit report may not be legally removed. Incorrect information may be removed by disputing the information to the credit bureau involved.

LendingTree does not charge you a fee to use the LendingTree service.

You are not required to use LendingTree’s computerized loan request services to obtain a residential mortgage loan; and that the full range of loans available as offered by Lenders may not be listed on LendingTree’s computerized loan request services system, and different terms and conditions, including lower rates, may be available from others not listed on the system.

If your loan request is forwarded to one or more participating Lenders you may receive from the Lenders a good faith estimate of settlement costs under RESPA and an initial disclosure statement required under the TILA.

The interest rate quoted in connection with the loan you select is subject to change without notice unless and until an interest rate lock-in agreement has been made between you and the Lender. LendingTree does not offer lock-in agreements and does not guarantee any rate of interest quoted by a participating Lender. If you enter a lock-in agreement with the Lender and are required to pay a lock-in fee, the terms and conditions under which the lock-in fee may be refunded, if any, will be set by the Lender.
LendingTree will not collect any fees from you in connection with your completion of a loan request. All fees will be collected from and payable by the Lender. If the Lender is licensed under the Mortgage Broker Practices Act, the fees paid by you for third-party provider services (such as an appraisal or credit report), may be held in a trust account and any moneys remaining after the payment to third-party providers will be refunded to you.

If you are unable to obtain a loan for any reason, the Lender, if licensed under the Mortgage Broker Practices Act, will, within five (5) days of a written request by you, give copies to you of any appraisal, title report, or credit report paid for by you, and transmit the original appraisal, title report, or credit report to any other mortgage broker or lender to whom you direct. Transmission of these reports includes the right to use these reports. You are also entitled to receive a copy of any appraisal paid for by you, pursuant to the federal Equal Credit Opportunity Act.

Washington state law against discrimination prohibits discrimination in credit transactions because of race, creed, color, national origin, sex, or marital status. The Washington State Human Rights Commission administers compliance with this law.

LendingTree receives fees from participating Lenders and may be paid services, goods or facilities performed or provided by us to the Lender.
